Scott,
I don't think you're being fair to yourself or your company to defend the situation regarding re-e-power.
If Kevin knew he was in a difficult situation it would have been best to not accept payment for his product at $3665.00, knowing that he either didn't have the product available or that he didn't have the available funds to construct the product as advertised. I also don't know why he wouldn't have the individual's money available for refund if he couldn't supply the advertised product.
The members of this site know that there are very few electric power manufacturers out there and that those that are there are suffering the same fate as the rest of the boating industry in general.
Products such as yours as well as the re-e-power unit are not lined up in warehouses by the hundreds of thousands like an alternator for a Ford or Chevy automobile, but rather are probably custom made a few at a time. If you have a few or several units waiting for buyers you are likely anxious to move them out and recoup your costs plus profit so you can make more and keep the cycle going. That is the way small business works and nothing is wrong with that.
If the allegations against re-e-power and Kevin are true, it would seem that with no product available, he should not have accepted the money, or place the money in a business account that was not used for any purpose other than supplying that advertised product.
That said, I hope no one on this site thinks less of your company by your attempt to offer explaination for re-e-power. Most people in this country have been hit by the economy and wish small business the best.
Your product appears to be well engineered and manufactured to do the job required of it. I'm sure if someone purchases one of your many systems, that the product is there or that you would use the purchase money to construct, test and ship a finished product to that consumer in a timely and honest manner.
Good luck,
Kevin Torpey
